These Terms of Use (“Terms”) govern your access to and use of the Wega platform, including the website and mobile application (collectively, the “Platform”), operated by Wega Guide OÜ, a private limited company registered in Estonia with registry code 17222549, registered address at Harju maakond, Tallinn, Lasnamäe linnaosa, Sepapaja tn 6, 15551 (“Wega,” “we,” “us,” or “our”). Contact us at team@wega.guide or at support@wega.guide. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
Eligibility
Minimum Age: You must be at least 16 years old to use the Platform. By using the Platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
Reporting Underage Users: If you become aware of a child under 16 using the Platform, please notify us immediately at support@wega.guide. We will promptly delete their account details and associated personal data upon verification.
Services
Wega is an intermediary platform connecting individual travelers (“Buyers”) with travel bloggers, professional guides, and businesses (“Sellers”) to discover, create, and purchase self-guided travel routes. Services include:
Point-to-point maps with audio guides and photos for self-guided tours.
A route builder for Sellers to create and share routes.
Audio guides, which may be user-generated (recorded by Sellers) or machine-generated.
The Platform integrates third-party services, including Stripe for payments, OpenStreetMaps for maps and navigation, and Amplitude, Google Ads, and Facebook Analytics for user activity analytics.
User Accounts
Account Creation: You must create an account to access the Platform’s features by providing accurate information, including your email address and password. You are responsible for maintaining the confidentiality of your account credentials.
Security: Notify us immediately of any unauthorized use of your account at team@wega.guide.
Termination: We may suspend or terminate your account for violations of these Terms, including providing false eligibility information or posting illegal or inappropriate content.
User-Generated Content
Ownership and License: You retain ownership of content you upload (e.g., route descriptions, photos, audio recordings, reviews). You grant Wega a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such content on the Platform solely for the purpose of operating, promoting, and providing the Platform’s services (e.g., displaying routes to Buyers).
Responsibility for Third-Party Content: Sellers are solely responsible for ensuring photos or other content uploaded do not infringe third-party rights (e.g., copyright). You must credit third-party authors where required or bear all consequences of infringement.
Moderation: We review uploaded content within 1-3 working days and may remove content that is illegal, offensive, or violates these Terms.
Prohibited Content: You may not upload content that:
Promotes illegal activities or violates applicable laws;
Is defamatory, obscene, or harmful to minors;
Infringes intellectual property rights (e.g., copyright, trademarks).
Commercial Users
If you are a Seller offering routes or services via the Platform:
Commission and Fees: Wega charges a 15% commission on each sale. Sellers are responsible for Stripe transaction fees, deducted from their portion of the payment.
Ranking: Route rankings are based on user reviews, relevance, and quality. We do not prioritize our services over Sellers’ without clear disclosure.
Data Access: Sellers may access data they provide or generate, subject to our Privacy Policy.
Complaints: Contact support@wega.guide for issues. We aim to resolve complaints within 7 working days.
Payments and Refunds
Purchasing Trips: Buyers pay for trips via Stripe. All prices include applicable taxes.
Waiver of Withdrawal Right: By purchasing a trip, Buyers consent to immediate access to digital content (e.g., maps, audio guides) and waive their 14-day right of withdrawal under EU consumer law. No refunds are available after access (Pressing the ‘Start’ button) unless Wega determines otherwise (e.g., for technical issues).
Seller Payouts: Wega transfers Sellers’ earnings (minus commission and Stripe fees) to their designated accounts. Sellers bear any additional payout fees charged by Stripe.
Payment Disputes: Wega is not liable for disputes arising from payment processing errors by Stripe.
Intellectual Property
Wega’s Proprietary Content: Content created or licensed by Wega, including machine-generated audio guides, Wega-uploaded tours, proprietary map designs, user interface designs, software code, and related development outputs (e.g., algorithms), is owned by Wega Guide OÜ or its licensors and protected by copyright, design rights, or other intellectual property laws. You may not reproduce, distribute, or use such content outside the Platform without our written permission. This does not include third-party or open-source components (e.g., OpenStreetMaps, licensed libraries), which are subject to their respective terms.
User-Generated Content: As stated in User-Generated Content Section, Sellers retain ownership of their uploaded content (e.g., route descriptions, photos, audio recordings). Sellers warrant that their content does not infringe third-party intellectual property rights (e.g., copyright, trademarks). Wega is not liable for IP disputes arising from user-generated content.
Limitation of Liability
To the fullest extent permitted by law, Wega is not liable for:
Indirect, incidental, or consequential damages arising from your use of the Platform.
Inaccuracies in user-generated content or third-party services (e.g., OpenStreetMaps, Stripe).
Service interruptions due to technical issues, maintenance, or force majeure.
Data Protection
Your personal data, including names, emails, payment details, and location data, is handled in accordance with our Privacy Policy. We use cookies (essential for app functionality) and tracking technologies via OpenStreetMaps, Amplitude, Google Ads, and Facebook Analytics. Data is shared with third parties (map providers, analytics tools, Stripe) as outlined in the Privacy Policy.
Termination
We may terminate or suspend your access to the Platform, with notice where feasible, if you breach these Terms. Upon termination, your right to use the Platform ceases, but provisions on liability, intellectual property, and dispute resolution survive.
Changes to Terms
We may update these Terms at any time. We will notify you of material changes via email or in-app notifications at least 30 days in advance, except where changes are required by law. Continued use after changes constitutes acceptance.
Governing Law and Dispute Resolution
These Terms are governed by the laws of Estonia. Disputes shall be resolved through mediation where possible. If mediation fails, disputes will be settled in the courts of Tallinn, Estonia, except for EU consumers, who may bring claims in their country of residence.
Tourism Compliance
Sellers must ensure routes and guides are accurate and comply with local tourism regulations. Wega is not liable for inaccuracies or legal violations in Seller-provided content.
